A ride will pick you up from the airport upon your arrival. Once you have met your driver, you will drive through the city of Arusha. On this drive to the hotel, you may get treated to your first glance of Mount Kilimanjaro.
Arrive and check into Aishi Machame Hotel, which is quietly nestled in the green foothills of Mt. Kilimanjaro. Aishi Machame Hotel is a perfect place to recharge and gain strength before the climb. The territory of the hotel is one lush, beautiful garden with trees blooming and birds chirping all around. Many wild animals have long made Aishi Machame Hotel their permanent residence.
If you need any gear, Altezza will assist you with rentals that you can use for the duration of the trip. They are equipped with top-of-the-line outdoor gear that will perfectly suit the expedition up Mount Kilimanjaro.

Early morning breakfast and coffee with the group at Aisha Machame Hotel before we depart to hike Kilimanjaro.
A guide and the mountain support crew will arrive at the hotel in the morning in order to meet you and hold a quick briefing, after which you will travel by vehicle (roughly 3–4 hours) to Kilimanjaro National Park's western entrance: Londorossi Gate. After the quick formality of acquiring climbing permits and registering with the search and rescue service, the group continues upwards towards their drop-off point by off-road vehicles (reaching 3,400 meters or 11482 feet). Here you will see stunning views of the Shira Plateau for the first time.
The route from your drop-off point to your first high-altitude camp, Shira 1 features a small gain in altitude and is not very challenging physically. Due to this, you will be able to begin the process of acclimatization properly. By the time you reach the camp, our professional mountain crew will have already prepared everything necessary, put up the tents, and begun preparing dinner.

This section of the route has a lot of ascents and descents that end at a camp at over 4,600 meters (15091 feet) above sea level. It might be difficult, and it is common to feel some discomfort, but in order to successfully acclimate to the altitude you have to spend at least 1–2 hours here. For that reason, your group will enjoy your lunch at the top of Lava Tower, in order to help you acclimatize better.
Then you will descend to Barranco Camp. There you will see the famous Barranco Wall, impressive in both its massive size and steepness! The next day you will be climbing it, but don't worry, it features a very simple hiking trail and is not intimidating at all.

On this day your group will make an early start and after a filling breakfast, begin to hike Barranco Wall. We recommend you leave the camp as early as possible to avoid crowds of the other groups, which can slow you down. Hiking up the gorge wall is not difficult and only takes around an hour. After the climb, you can have a rest and take photos in front of the Kibo volcano.
Then you will start a more difficult hike to Karanga Camp, which features numerous ascents and descents on the route, but don't worry: our guides are experts at choosing an optimal pace for the group. After reaching the camp you will be offered warm lunch.
After a couple of hours, you will have to complete an acclimatization hike in the direction of Barafu Camp with a 200-meter (656-foot) gain in altitude, and then descent back down to the camp.
Here, you will be greeted with dinner. On this day, we will have a few hours of downtime. During this time, you can rest and shoot photos with Justin if conditions are good.

In the morning, after a warm and hearty breakfast, you will begin your hike to Barafu Summit Camp. This camp is the starting point for the final night summit to Uhuru Peak (5,895m/19340f) - your end goal. Our team will set up camp ahead of time, so when you arrive your tents and sleeping bags will already be prepared, meaning you can just relax and rest when you reach Barafu Summit Camp.
After regaining strength, you will have to complete an acclimatization hike towards the intermediate Kosovo Summit Camp (4,800m/15748ft) and then back to Barafu Camp, where you will be served a hot dinner. It is better to spend the remainder of the day resting and sleeping before the night summit.

Reaching the summit is the literal and figurative peak of your Kilimanjaro trek. This night, you will depart the camp and walk along the edge of the crater rim. Finally, you will climb to the highest point in Africa, Uhuru Peak, and stand at 5,895 meters. This is truly a great achievement and a test of your own strength and stamina. Standing on the summit of the tallest mountian of Africa and Watching the sunrise will truly be one of the most magical moments of your life. ( When I say this happened back in October, it brought tears to my eyes. I was truly one of the most magical moments of my life, and I have been fortunate to see and experience a lot of things.)
In order for your climbing group to reach the summit by dawn, you will depart the camp around midnight. During the ascent, a team of special high-altitude porters will join the guides of Altezza Travel to assist climbers. These porters are selected because they have expressed their interest in becoming guides and want to expand their experience by learning the route and requirements to help climbers reach the top. As they have been undergoing additional training, they are prepared to help ensure the safety of climbing participants and alert the guides to any issues immediately. Altezza Travel insists on having a ratio of climbers to guides or guides-in-training of 1:1 for the final ascent. This means that a well-trained specialist in our company will be helping each expedition participant as they climb through the night to reach the summit.
During the final stages of the climb, the guides will have thermoses with hot tea, first-aid kits, and oxygen cylinders. They will constantly monitor the well-being of the participants and offer assistance as needed. This may be a warm drink to help re-energize you to reach your goal or help carry your backpack during the last push.
Once you arrive atop Uhuru Peak, you will spend about 30-40 minutes taking photos and watching an amazing sunrise with a view across Africa. If you still have enough strength, you can ask the guides to descend into the crater and walk to the distant glaciers. As the sun rises, an interesting play of color begins - the rays of the sunshine on the surface of the glaciers give them a lovely peach hue, like something from another world. Unfortunately, the glaciers are expected to melt very soon, and your trek up to Kilimanjaro is one of the last opportunities to witness them in person.
As the morning progresses, you will trek back down to the camp, where an energizing meal awaits your team. While eating, you can recover a bit from strenuous trekking, enjoying a nice afternoon before moving on to the final part of your adventure.

After the group has made it back to Barafu Camp we will rest for a few hours before we continue our descent to Millennium Camp. The Hike from Barafu Camp to Millennium Camp if very easy. Justin and his buddy Elliott ran down this section and made it to camp within 1.5 hours. ( Running is not recommended hahaha)

Millennium Camp is situated in a tropical rainforest. When you wake up, you will feel relief from the reduction of the altitude and the satisfaction of reaching the summit. After a warm breakfast, you will head for the national park's exit: Mweka Gate. After your descent the whole group will gather to congratulate you, followed by offering you a chance to share your opinions on the climb in the guestbook. Lastly, we will present you with your commemorative certificates in our office and provide you with a transfer back to the Aishi Machame Hotel.
Once we arrive at the Aishi Machame Hotel, we can head to our rooms, relax and eat and drink and chill by the pool.
Depending on how everyone is feeling, we can have a group editing session. Back-up footage from the climb.August 02 2024
This will be a rest day. We can enjoy breakfast and coffee at the hotel before checking out of your room.You can relax by the pool with a cocktail, have Spa, go shopping or do a day-trip to one of the smaller local gems. There's plenty of options to choose from and suit your individual travel style.
Around noon, we will hop our transportation and drive to our next hotel for the night , Gran Melia Arush. This oasis within Arusha is set on 18 acres of beautifully landscaped coffee and tea plantations. Here, we will spend the remainder of the day chilling at the hotel. We can all meet up for another group editing and disscussion session. For the rest of the day, you can help yourself to the many amenities that the hotel has to offer, from a tranquil spa and heated pool to 24-hour gym, and 1.5 km running track; the choice is all yours.
For dinner we will meet at one of the hotel restraunst where we and wine and dine as we recover from the trekk.August 03 2024
Today your safari will take place in Tarangire National Park. This is one of the most interesting places in Tanzania! The river of the same name flows through the park, where giraffes, zebras, antelopes and buffaloes come to drink. These animals attract predators, which is why a lot of lions live in Tarangire. You will definitely see them during your trip.
During the dry season, the Tarangire River becomes the only source of drinking water for many kilometers around. Because of this, large herds of elephants come to Tarangire, making Tarangire the home to the largest population of elephants in Northern Tanzania for most of the year (especially June - October and December - March). Elephants are not at all intimidated by visitors to the park, and they often come quite close to cars. This is completely safe - since elephants have no enemies in their natural nature they are naturally curious and unafraid.
After our safari we will head to our next hotel which is located in the Ngorongoro Crater. This place will blow your mind. Once we have rrived at our home for the night we will check into our rooms. After we are all settled in we can meet for dinner, back up or footage from the day and then end the day with another group editing session. Here you can have 1:1 time with Justin where you are more then welcome to ask any questions you have.July 29 2024
Today you are going to the Legendary Ngorongoro Crater!
Our day will start early with breakfast and before our guide arrives to drive you to the Ngorongoro Crater, part of the Ngorongoro Conservation Area. The Crater is somewhat reminiscent of The Lost World by Sir Arthur Conan Doyle: here you will witness tens of thousands of wild animals living in the massive crater left by a huge ancient volcano. The actual crater is relatively small, when you consider that it is home to the most variety of animals per square meter than anywhere else in the world! Here, you are sure to see a great number of animals within close proximity to one another.
The descent into the crater will take about half an hour of driving. The road passes through beautiful, lush forests with great scenery. Your safari guide will make a stop to see the ‘look out’ which is a place offering a stunning panoramic view of the entire crater. Contrary to popular myth, animals can go outside the caldera. However, most of them are safe and comfortable inside the caldera which provides an unlimited supply of fresh grass for grazers and easy prey for predators. Therefore, they prefer to remain in the crater t all the time.
Elephants, buffaloes, antelopes, lions, cheetahs, zebras and other African animals can be seen in Ngorongoro Crater. This is one of the few places in Africa where rhinos are found, although, remember that they are an endangered species, so there are very few of them. One animal that is absent are giraffes; you will not spot any of them in the crater because, due to the build of their bodies, including legs and long necks, they cannot walk down into the crater.
After your morning game drive around the crater, you will stop at the picnic area next to Lake Magadi for a snack and rest. This place is popular with various birds, including kites, who sometimes try to steal food right from the table! While not dangerous, at all, it is a good idea not to leave any food unattended. One of the draws of Lake Magadi are the hippos that live in the area. You’re sure to enjoy watching them while you eat lunch. These huge animals stay close to the shore and often surface to get air. If you do see one walking out of the water, give it plenty of space. Due to the large number of animals and endemic plants, Ngorongoro Conservation Area is a UNESCO World Heritage Site and renowned for its natural significance in the world.August 05 2024

About The Trip.
This summer, Justin has chosen to host his third group trip in one of the most beautiful and wild landscapes he has ever visited. This July, you will have an exclusive and unique opportunity to join Justin in Tanzania to hike the world-famous Mount Kilimanjaro and then venture onto the plains of Africa to photograph some of the most unique animals in the world in their natural environment. This will truly be the most wild and life-changing experience of your life.
This workshop/group trip is intentionally set in the heart of Tanzania to capture the essence of its unparalleled natural wonders. Dominated by the monumental Mount Kilimanjaro, with its snow-capped peak and diverse ecosystems, it creates an epic setting for our photographic journey. Tarangire National Park, with its majestic baobabs and throngs of wandering elephants, alongside the verdant, wildlife-rich Ngorongoro Crater, provides a canvas of breathtaking landscapes and vibrant life. The dry season unveils a unique beauty, offering a rare glimpse into the soul of the Tanzanian wilds. It is in these iconic African settings, steeped in natural majesty, that our workshop finds its true purpose, amidst the legendary landscapes of Tanzania.
For this trip, we have partnered with the top guiding company in Africa. Travel Altezza will be guiding us to the summit of Mount Kilimanjaro. This will be Justin’s second trip with Altezza, and from firsthand experience, he has witnessed the first-class service they provide as well as how well they treat their employees. This is of the utmost importance when visiting and partaking in an activity such as climbing the tallest mountain in Africa. Once we have made it to the summit of Mount Kilimanjaro to watch the sunrise light up the plains of Africa, we will embark on a 2-day safari. Here, you must prepare to have your mind blown. You will get to witness firsthand the true magic of Africa. Being able to see lions, zebras, elephants, and leopards up close and personal will change your life, and I can promise you it will be an experience you tell your grandchildren about one day.Quietly nestled in the green foothills of Mt. Kilimanjaro, Aishi Machame Hotel is the perfect place to recharge and gain strength before the climb. The hotel's territory is a lush, beautiful garden with blooming trees and chirping birds all around. Many wild animals have long made Aishi Machame Hotel their permanent residence. On a warm day, you can go to the swimming pool, cozily fenced by the greenery, and bask in the African sun. During our hike up Mount Kilimanjaro, you will be provided with high-end 4-season tents, mess tents, hot water, as well as clean drinking water, plus more food than you could possibly eat as you will be burning a high amount of calories each day. You will receive a 5-star experience. Justin has attended multiple treks around the world with tour groups, and Altezza's service on Kilimanjaro was by far the best, so I guarantee you, you will be well taken care of. Once we make it down from Mount Kilimanjaro, we will head back to the Aishi Machame Hotel. Here, we will rest and relax by the pool. Following our stay, we will jump into the safari vehicle, which is a new 4x4 Land Cruiser, enclosed to keep you safe from the elements as well as the wildlife. From the Aishi Machame Hotel, we will head out on our first safari. For our first night, we will be staying at Ngorongoro Marera Mountain View Lodge, and following our stay there, we will spend the next night at Melia Hotel before departing for your next adventure the following day.
This is one of the top trekking routes for Kilimanjaro, with beautiful panoramic landscapes. Climbing Mount Kilimanjaro is fairly doable if you are in good physical condition and have the willpower to make it to the summit. While Justin was there last October, he personally saw trekkers of all ages and physical conditions make it to the top. Back in 2022, there was an 80-year-old lady who made it to the summit. The route we will be taking is called Lemosho. This route begins at an altitude of 3,400 meters (11,483 feet) above sea level on the western slope of Kilimanjaro. You will pass through five climatic zones of Kilimanjaro, including equatorial, rainforest, and arctic. It will be a very unique experience.
Altezza Travel recommends the seven-day Lemosho route for both beginners and experienced mountain hikers. The ascent is quite simple in technical terms; you don't need any special equipment or climbing skills to reach the summit. According to our statistics, 98 out of 100 people successfully reach the summit along the seven-day Lemosho route, making it the most successful route of all! This is one of our go-to routes, and it is along Lemosho that Altezza has led the legendary Wings of Kilimanjaro expeditions, as well as the trekking teams of Red Bull, National Geographic, Netflix, and world-famous mountaineer Nirmal Purja, aka Nimsdai.

During your time on this two-day safari, you will venture out into two of Tanzania's most famous national parks: Tarangire National Park and the legendary Ngorongoro Crater. Here, you will get to witness firsthand the beauty of Tanzania's wildlife, and if we are lucky, we will get to see some of the last remaining rhinos, as well as lions, elephants, cheetahs, leopards, and dozens of other wildlife species. During this workshop, you will have plenty of opportunities to learn from Justin and learn how to capture viral-worthy content of the African wildlife. He will help you craft a compelling storyline for producing a viral reel of one of our treks and guide you in photographing and capturing images of our adventures. The goal of this section of the workshop is to show you how to effectively use your camera and phone to create a compelling story and a set of images that will not only attract brands but also generate income for you. Each day after we get back from the safari, we can all sit back, sip tea, and have multiple group editing sessions.Just as Justin approaches photography and business with flexibility, the workshop's schedule has been crafted to remain adaptable and responsive to opportunities that arise. The goal of this trip is to teach you how make money from content creation, experience a real world assignment and travel with a group of like-minded individuals and experience standing on top of the roof of Africa during sunrise ( Trust me this will bring tears to your eyes ).

Tanzania, in general, is considered safe for women travellers. However, as with any destination, it's essential to take common-sense precautions to ensure your safety. While on this trip you will be with guides and you will be staying in safe hotels that are guarded 24/7. During the trip all women will have separate tents and rooms from the opposite gender unless otherwise requested.
Extensive Gear Rental Shop. Altezza Travel boasts the largest gear rental shop on Kilimanjaro, providing climbers with easy access to top-notch hiking equipment. While other operators might offer limited items like sleeping bags and jackets, the Altezza has everything, from hiking poles to appropriate footwear, sleeping bags, backpacks, you name it and it’s all top of the line gear. So basically you don’t need to bring anything with you.
Abundant Camping Equipment. Among Kilimanjaro operators, Altezza Travel stands out with the largest stock of camping equipment, ensuring both comfort and safety. With over 300 robust 4-season mountain tents and a staggering inventory of 400+ oxygen tanks, they surpass the combined resources of all other operators on Kilimanjaro. This extensive supply allows them to use oxygen not only in response to altitude sickness symptoms but also proactively during the early days of the hike for smoother acclimatization.
Double Daily Medical Check-ups. Altezza guides conduct medical checks every morning for both the crew and clients, identifying early signs of mountain sickness and adjusting hiking pace for optimized acclimatization. Individual medical cards track each participant's acclimatization progress and well-being throughout the trek.
Comprehensive Medical Kits. Altezza Travel is the sole company equipped with comprehensive medical kits covering a broad range of health issues that may arise on the mountain. There kits include over 50 types of medications for various injuries and emergencies, surpassing the standard Kilimanjaro medication provided by other operators.
Hotels . Altezza Travel owns two hotels near Mount Kilimanjaro, namely Aishi Lodge and Brubru Lodge. This means you don’t have to worry about finding accommodations when you are on your trip. Everything is taken care of.
Food. Altezza will provide you with all the food you need during the trek. Each day, we will start with a cup of coffee or tea, which will be brought to your tent before breakfast. For breakfast, you will enjoy toast, sausages, eggs, crepes, and a fruit bowl. During your hikes, you will have a tea break where the cooks will meet you halfway. They will set up a table and provide you with hot tea, coffee, cookies, and cake, giving you time to warm up and rest before continuing your hike to camp.
Once you arrive at camp, you will be greeted with a warm bowl of soup, popcorn, and cookies. For dinner, you will have a range of meals to choose from, including chicken, fish, rice, stew, pasta, fresh fruit, and vegetables. Additionally, clean drinking water and warm washing water will be provided to help you stay clean.
Guides: The guides are extremely knowledgeable and experienced especially compared to other companies. Our guide's names were Stanley and Gerald both of them have climbed Mount Kilimanjaro over 180 times over the last sixteen years. So they know what they are doing. And the entire team was extremely friendly and respectful and went out of there way to make sure we were comfortable and made it to the summit.This workshop is open to all levels of photographer, Justin will cater to beginner through to advanced. And you don’t even need to be a photographer to join - you're more than welcome to come for the experience and enjoy the good company in nature!

Depending on your carrier, you may or may not have service. Service is very spotty. The hotels do offer Wi-Fi internet access, as do the safari vehicles. While on the trek up Mount Kilimanjaro, there will be spots of cell service.
To maximize your time with this workshop, please bring the following:DSLR/Mirrorless Camera body with at least one lens or a iPhone or action cam.Laptop computer for editing and for note taking if desired (or a pen and notebook)Appropriate clothing and gear for hiking long stretches over varied terrain. This includes good hiking shoes or boots, a waterproof jacket, a hat and gloves, and a warm layer for the cold late evening. The weather can change in an instant, so be prepared!(A helpful packing list will be provided before the retreat)Good vibes and a willingness to learn.
Maintaining a reasonable level of fitness is crucial to climb Kilimanjaro. However, summiting Kilimanjaro doesn't require athletic prowess. A healthy average would be adequate. As a guideline, we suggest assessing whether you can comfortably hike 8-10 km (5-6.2 mi). If you can do it, then you are fit enough to climb Mount Kilimanjaro.
A great exercise for hiking Kilimanjaro is running. Keep training until you can confidently jog 4-5 km (2.5 - 3.1 miles). Good training programs are available at the Nike Running Club app.
Swimming is an excellent complement. Swimming strengthens your entire body and improves your heart and lung endurance. This makes it a great addition to running. The first primarily focuses on leg endurance. Swimming takes it further by engaging the arms, core, and legs at the same time. Water buoyancy is also good for people who want to protect their joints while exercising.
Finally, it is great if you have any rural areas nearby with rough hiking trails. Aim for longer ones, ideally in the 10-15 km (6-10 mi) range. Remember, most of the Kilimanjaro hike will be uphill. So, training over longer distances in the countryside will prepare you for the Roof of Africa.

On a Kilimanjaro trek with Altezza Travel, every climber receives a balanced diet designed specifically for the mountain environment. Our specialized menu is rich in calories and carbs to provide you with ample energy.
For breakfast, we serve porridge, pancakes, fruit, eggs, sausages, and toast with jam. Lunch or dinner options include delicious soups like butternut, tomato, leek, vegetable, and beef, potato dishes, spaghetti, chicken, stews, fresh vegetable salads, and avocado. All meal courses are served with delicious sauces and dressing. For dessert, we have mangoes, bananas, pineapple, and oranges. They give you important vitamins and minerals. Coffee and tea are always available in the camp.
We also have extended meal plans for vegetarians, vegans, and gluten-free climbers. We will do our best to accommodate other diets also.
Throughout the trek, our guides will frequently pause for tea with biscuits. Nonetheless, climbing Kilimanjaro demands considerable energy. Hence, we recommend you bring snacks such as energy bars, dried fruits, and high-calorie treats. It's preferable to purchase these at home. There might be a much broader variety of such products available in your country compared to Tanzania.
Altezza offer tents, thick sleeping mattresses, tables, tableware, chairs, and other equipment. However, you must bring your own hiking gear. This includes boots, a sleeping bag, duffle bags, pants, trekking poles, and other items from the packing list.
When you climb Mount Kilimanjaro, the temperature changes a lot. It can be as hot as 25°C/77°F and as cold as -15°C/5°F. It is essential to bring clothes for all kinds of mountain weather.

I won't delve too deep into this topic, but here are a few main reasons why you have to climb with a certified operator:
It's the law: To enter the park, the government has made it mandatory to go through a checkpoint to access the trailhead.
It provides jobs for the locals: Kilimanjaro offers thousands of jobs to the local people of Tanzania. From porters to guides to farmers who provide food for the expeditions, everyone relies on Kilimanjaro to survive. By going there, you are helping these humble people survive. This is rarely seen in Western culture, but these people are extremely grateful for this industry, and it's a unique thing to witness. When you arrive at Kilimanjaro, you see what I am talking about. It's pretty cool.
Safety:The hike may be easy, but it can still be deadly. If you don't know what you are doing, you could get hurt or very sick from the altitude. If you choose a company such as Altezza, you will be with guides who have extensive medical training and are well-equipped to handle any medical situation they come across.For a safari, choose shirts and pants in neutral colors like khaki or gray to blend in and hide dust. Avoid white, blue, and camouflage clothing. Blue attracts tsetse flies and camouflage is restricted for civilians. Dresses are great for lodges but pants are practical for drives. Remember sun protection: a wide-brimmed hat, sunglasses, and sunscreen. For footwear, sandals are fine for lodges, but closed shoes are better for drives. Regular visitors are not permitted to operate drones in Tanzania's national parks. However, special permissions can be obtained for filming projects. This process typically takes 3-4 months and incurs additional costs. Bringing a drone into Tanzania without the necessary permissions risks confiscation by customs officials upon arrival. Wi-Fi is available in our safari vehicles. However, please note that in the more remote areas of national parks, coverage might be limited. You can also expect Wi-Fi in hotels and lodges across Tanzania. The connection in those locations can sometimes be intermittent too.

YOU WILL BE BOUND BY ALL UPDATES TO THIS AGREEMENT AS MORE FULLY SET FORTH IN SECTION 10 OF THIS AGREEMENT. NO CHANGES (ADDITIONS OR DELETIONS) BY YOU TO THIS AGREEMENT WILL BE ACCEPTED BY THE COMPANY. THUS, IF YOU DO NOT AGREE TO ALL THE TERMS AND CONDITIONS OF THIS AGREEMENT, THEN YOU SHOULD NOT ACCESS OR OTHERWISE USE THE SITE OR ANY OTHER COMPANY PROGRAMS. THIS AGREEMENT CONSTITUTES A BINDING CONTRACT BETWEEN YOU AND THE COMPANY AND YOU SHOULD DOWNLOAD AND PRINT THIS ENTIRE AGREEMENT (INCLUDING WITHOUT LIMITATION THESE TERMS AND THE COMPANY’S PRIVACY POLICY, AS DEFINED ABOVE) FOR YOUR RECORDS. PRIVACY NOTICE ALL USERS (INCLUDING WITHOUT LIMITATION ALL TRAVELERS AS DEFINED HEREIN) ARE DIRECTED TO SECTIONS 4 OF THIS AGREEMENT FOR A LINK TO THE COMPANY’S PRIVACY POLICY. WITHOUT LIMITING THE PROVISIONS OF SECTIONS 4 and 5.21 HEREIN OR ANY OF THE PROVISIONS OF THE COMPANY’S PRIVACY POLICY, A USER’S USE OF ANY COMPANY PROGRAM, INCLUDING WITHOUT LIMITATION BOOKING ANY TRIP, CONSTITUTES YOUR AGREEMENT TO OUR COLLECTION AND PROCESSING OF YOUR PERSONAL INFORMATION, INCLUDING THE USE OF COOKIES, PURSUANT TO THE COMPANY’S PRIVACY POLICY. PLEASE READ THE COMPANY’S PRIVACY POLICY (SEE SECTIONS 4 and 5.21 HEREIN) CAREFULLY AS IT CONTAINS IMPORTANT INFORMATION ABOUT OUR COLLECTION, USE, STORAGE, DISCLOSURE, AND TRANSFER OF YOUR INFORMATION. IF YOU DO NOT AGREE TO ALL OF THE TERMS OF THE COMPANY’S PRIVACY POLICY, THEN YOU MAY NOT USE THE SITE OR ANY OTHER COMPANY PROGRAM. 1. Definitions. The following terms have the following meanings: 1.1 “Access Right” has the meaning set forth in Section 2 herein. 1.2 “Booking(s)” or “Book a Trip” has the meaning set forth in Section 5 herein. 1.3 “Cancellation" means any significant date alteration not caused by a Force Majeure event or the complete removal of a trip from sale and future operation by any party. 1.4 “Company IP Assets” has the meaning set forth in Section 3.2 herein. 1.5 “Company Privacy Policy” has the meaning set forth in Section 4 herein. 1.6 “Company Server” or “Server” means the computer software or hardware that serves and hosts the Website or Company Programs to users across the Internet. 1.7 “Content” means any data, information, messages, text, photos, graphics, videos, messages, tags, works, material or any other content, including, without limitation, any personally identifiable information. 1.8 “Designer Trip” or “Designed Trip” means specified itineraries for independent Travelers that do not include participation by a Host or Trip Leader, or specific structured events other than the outlined features for the specific Designer Trip. The Designer Trip itineraries will vary by departure and availability. The cancellation and deposit requirements for Designer Trips will be displayed on the specific Designer Trip page, and cancellation policies may vary from the Justin Choquette Studio standard cancellation terms set forth below. 1.9 “Host” means the influencer, entrepreneur, or other business that hosts a Trip which Travelers can then Book by using the Justin Choquette Studio Website or other authorized Company Program. 1.10 “Organizer” has the meaning defined in Section 5 herein. 1.11 “Reschedule” means a trip that has been postponed due to a Force Majeure event. The newly scheduled dates will be within 14 months of the previously planned departure. 1.12 “Traveler” means any individual user of the Justin Choquette Studio Website or other authorized Company Program who Books a Trip using such a Company Website or other Company Program. 1.13 “Trip” means the itinerary with identified host, dates, and price as more specifically described on the Justin Choquette Studio Website. 1.14 “Trip Credit”: voucher payment which must be applied towards a new trip within 365 days of issue. 1.15 “Trip Leader” The local representative assigned by the “Operator” who is the authority on the trip organizing the logistics and overseeing the group. 1.16 “Trip Payments” means the Trip payments that will be processed by Company as follows: 1.16.1 The Trip payment that Justin Choquette Studio will process on behalf of the Traveler who Books a Trip through the Trip Services, such payments to be processed and made by Justin Choquette Studio on behalf of the Traveler to the third parties as described in, and otherwise pursuant to, the terms and conditions of the Bookings. 1.16.2 The Trip fees paid by a Host while using the Trip Services which will be transmitted through the Trip Services from the Host to a third party as agreed to by Justin Choquette Studio pursuant to said Trip Services. 1.16.3 The Trip fees paid to an Operator while using the Trip Services which will be transmitted through the Trip Services from the Organizer to a third party as agreed to by Justin Choquette Studio pursuant to said Trip Services. 1.17 “Trip Services” means the following: 1.17.1 For Travelers, it has the meaning set forth in Section 5 herein; 1.17.2 For Hosts, it means the service offered to Hosts through the Website or other Company Program to assist the Host in coordinating certain logistics of a Trip for Travelers and Organizers; and/or 1.17.3 For Operators, it means the service offered to Operators through the Website or other Company Program to assist the Operator in coordinating certain logistics of a Trip for Travelers and Hosts. 1.18 Workshops and Informal Gatherings. Workshop services are designed and executed by your Host. While your Operator may assist in the facilitation of these services, neither Justin Choquette Studio nor your Operator is responsible for the execution, content, or quality of this service type. 2. ACCESS AND CONDITIONS OF USE OF JUSTIN CHOQUETTE STUDIO WEBSITE AND ANY OTHER JUSTIN CHOQUETTE STUDIO PROGRAMS 2.1 Subject to all of the terms and conditions of this Agreement, Justin Choquette Studio hereby grants to a user a non-exclusive, revocable, and limited right to access and use this Justin Choquette Studio Trip Website or Justin Choquette Studio Program, including without limitation any of the Trip Services provided through the Justin Choquette Studio Website or Justin Choquette Studio Program, in strict compliance with this Agreement (“Access Right”). Justin Choquette Studio reserves the right to suspend or revoke this Access Right at Justin Choquette Studio’s discretion without notice. Notwithstanding the foregoing Access Right, Justin Choquette Studio also has the right to change, suspend, or discontinue any (or all) aspects or features of this Justin Choquette Studio Website or Justin Choquette Studio Program or any of the Trip Services at any time, and from time to time, including the availability of any content or features on this Justin Choquette Studio Website or Justin Choquette Studio Program or any of the Trip Services. This Access Right granted to user under this Agreement will immediately terminate upon the expiration, cancellation or termination of this Agreement for any reason. 2.2 User shall be responsible for obtaining and maintaining any equipment or ancillary services needed to connect to or access this Justin Choquette Studio Website or Justin Choquette Studio Program, including, without limitation, Internet connections, modems, hardware, software, and long-distance or local telephone service. 2.3 As a condition of each user’s use of this Justin Choquette Studio Website or Justin Choquette Studio Program, including without limitation any Trip Services, the user covenants to Justin Choquette Studio that: (a) user shall not use the Justin Choquette Studio Website or Justin Choquette Studio Program (including without limitation any Trip Services): (i) for any unlawful purpose or for any purpose that is prohibited by this Agreement; or (ii) in any manner that could damage, disable, overburden, or impair the Justin Choquette Studio Website or Justin Choquette Studio Program (including without limitation any Trip Services), or that would interfere with any other party's use and enjoyment of the Justin Choquette Studio Website or Justin Choquette Studio Program (including without limitation any Trip Services); and (b) user shall not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided through the Justin Choquette Studio Website or Justin Choquette Studio Program (including without limitation through any Trip Services). 2.4 Notwithstanding any assistance that Justin Choquette Studio may provide, the user assumes sole responsibility for the uploading and updating of any of the user’s Content that is contained in the Justin Choquette Studio Website or Justin Choquette Studio Program. 2.5. Users further agree as follows: 2.5.1 Without limiting the generality of the foregoing, user agrees to all of the following provisions: (a) User will not upload to, distribute or otherwise publish through this Justin Choquette Studio Website or Justin Choquette Studio Program any Content that is unlawful, libelous, defamatory, invasive of privacy or publicity rights, harassing, threatening, abusive, inflammatory, obscene, or otherwise objectionable; (b) User will not upload or transmit any Content that would violate the rights of any party, would constitute or encourage a criminal offense, or would otherwise create liability or violate any local, state, federal, or international law, (c) User will not upload or transmit any Content that may infringe any patent, trademark, trade secret, copyright, or other intellectual or proprietary right of any party anywhere; (d) User will not impersonate any person or entity or otherwise misrepresent the user’s affiliation with a person or entity; (e) User will not distribute or publish unsolicited promotions, advertising, or solicitations for any goods, services or money, including junk mail and junk e-mail; (f) User will not use the Justin Choquette Studio Website or Justin Choquette Studio Program for purposes not authorized by Justin Choquette Studio; and (g) User will not use the Justin Choquette Studio Website or Justin Choquette Studio Program for any illegal purpose or any fraudulent scheme or transaction. (h) User agrees to the Justin Choquette Studio Community Guidelines as outlined here: [link to community guidelines]. 2.5.2 In addition to the rights given to Justin Choquette Studio pursuant to Section 8 of this Agreement, user hereby grants Justin Choquette Studio a perpetual, worldwide, transferable, fully paid-up right to use any of the user’s Content to: (a) provide the user with the Trip Services contemplated by this Justin Choquette Studio Website or Justin Choquette Studio Program, under this Agreement or under any other contract between user and Justin Choquette Studio, including without limitation any other uses normally intended for users; (b) to assist or coordinate with any claims arising out of the use of the Justin Choquette Studio Website or Justin Choquette Studio Program, including without limitation any claims involving any Host or Operators; and (c) for any other lawful purpose in carrying out Justin Choquette Studio business, operation, or corporate purpose. 2.6 Without limiting the generality of any other provisions herein, User agrees to all of the following provisions: 2.6.1 Users are prohibited from violating or attempting to violate the security of this Justin Choquette Studio Website or Justin Choquette Studio Program or any Justin Choquette Studio Server (as defined herein), including, without limitation, (i) accessing data not intended for such user or logging into a server or account which the user is not authorized to access; (ii) attempting to probe, scan, or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization; (iii) attempting to interfere with service to any user, host, or network; or (iv) sending unsolicited e-mail, including promotions and/or advertising of products or services. 2.6.2 Any violations of any system or network security (including, but not limited to, that of this Justin Choquette Studio Website or Justin Choquette Studio Program or any Justin Choquette Studio Server) may result in civil or criminal liability; and 2.6.3 Justin Choquette Studio has the right to investigate occurrences that may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting Users who are involved in such violations. Justin Choquette Studio also reserves the right to cooperate with any and all law enforcement agencies, including complying with warrants, court orders, and subpoenas and disclosing to law enforcement agencies any information about any User and anything a user does with respect to this Justin Choquette Studio Website or Justin Choquette Studio Program. By user’s use of the Justin Choquette Studio Website or Justin Choquette Studio Program, user hereby authorizes Justin Choquette Studio to take such action. 2.7 If the user uploads, transmits, or otherwise contributes any Content (either owned by the User or otherwise) to the Justin Choquette Studio Website or Justin Choquette Studio Program, user hereby represents and warrants to Justin Choquette Studio that the user has the lawful right to distribute and reproduce such Content. Also, user is solely responsible for its conduct (and the conduct of its users) while using the Justin Choquette Studio Website or Justin Choquette Studio Program, including, but not limited to, all Content in any folders or web pages (if any), or through any other transactions or interactions user generates, transmits, or maintains via the Justin Choquette Studio Website or Justin Choquette Studio Program. Justin Choquette Studio takes no responsibility for any such online distribution or publication by user or by any other party. Justin Choquette Studio cannot and will not review every message or other Content that User or any other party may generate or post, and Justin Choquette Studio is not responsible for the Content thereof. 2.8 In addition to any other right to terminate this Agreement, Justin Choquette Studio hereby has the absolute right to immediately terminate, without warning, any account that it believes, in its sole discretion, breaches any of the provisions of this Section. 2.9 LIABILITY DISCLAIMER: The Content, products, and Trip Services published on this Website may include inaccuracies or errors, including pricing errors. In particular, Justin Choquette Studio does not guarantee the accuracy of and disclaims all liability for any errors or other inaccuracies relating to the information and descriptions of any accommodation, activity, meal, transport, and other travel products, including the package and trip details and services displayed on this Website (including, without limitation, the pricing, photographs, lists of hotels and amenities, general product descriptions, etc.). In addition, Justin Choquette Studio expressly reserves the right to correct any pricing errors on our Website and/or reservations made under an incorrect price. In such event, if available, we will offer you the opportunity to keep your reservation at the corrected price or we will cancel your reservation without penalty. 3. COPYRIGHTS, TRADEMARKS, AND OTHER INTELLECTUAL PROPERTY RIGHTS; RESERVATION OF RIGHTS. 3.1 It is Justin Choquette Studio’s policy to respect the copyright, trademarks, and intellectual property rights of others. Justin Choquette Studio has the absolute right to (i) immediately terminate, without warning, all rights (including, without limitation, all Access Rights and any rights of any user who (in Justin Choquette Studio’s determination) appear to infringe upon the copyright, trademarks, or intellectual property rights of others, and/or (ii) remove any such Content from a user from the Justin Choquette Studio Website or Justin Choquette Studio Program or used in any Trip Service that, in Justin Choquette Studio’s determination, may infringe the copyright, trademarks, or other intellectual property rights of any third party. 3.2 Each user agrees to the following: 3.2.1 Justin Choquette Studio or its licensors own all rights, title and interest, in the U.S. and elsewhere, in and to all trademarks, service marks (whether registered or common law marks), logos, and any other trade names displayed on or in the Justin Choquette Studio Websites and all other Justin Choquette Studio Programs (including without limitation the Justin Choquette Studio’s Trip Services) or otherwise embodied in or associated with any and all of the Justin Choquette Studio’s other products and services (hereinafter collectively referred to as “Trademarks/Trade Dress”). Users shall not use any Trademarks/Trade Dress in connection with any product or service that is not owned by Justin Choquette Studio, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits Justin Choquette Studio. All other trademarks not owned by Justin Choquette Studio which may appear in the Justin Choquette Studio Websites or any other Justin Choquette Studio Programs are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Justin Choquette Studio. 3.2.2 All content included on or made available through any Justin Choquette Studio Websites or any other Justin Choquette Studio Programs, including without limitation any text, graphics, logos, page headers, button icons, scripts, images, audio clips, digital downloads, and data compilations, and all copyrights contained or arising out of the foregoing, is and shall remain the sole property of Justin Choquette Studio and is protected by United States and international copyright laws (collectively, “Works”). 3.2.3 Without limiting the provisions of Section 3.2.1 or 3.2.2 above, user hereby acknowledges and agrees that Justin Choquette Studio or its licensors are the sole owners, worldwide, of all Trademarks/Trade Dress (as defined in Section 3.1.1 above), all Works (as defined in Section 3.1.2 above), and any and all other inventions, patents, logos, images, graphics, photos, videos, icons, content, features, functionalities, data, processes, techniques, software, website designs, copyrights, works, and all other intellectual property provided in, made available by using, or otherwise contained or embodied in, all Justin Choquette Studio Websites and all other Justin Choquette Studio Program, or otherwise used by Justin Choquette Studio in the furtherance of its Trip Services or any of its other products, services, or overall business (collectively “Justin Choquette Studio IP Assets”). 3.3 Justin Choquette Studio IP Assets are protected by the copyright, patent, trademark, and/or other intellectual property laws of both the United States and other countries. This Agreement shall not be interpreted to: (i) grant any rights to any user in or to any of the Justin Choquette Studio IP Assets except for the limited Access Right set forth and subject to the terms and conditions of Section 2.1 of this Agreement; or (ii) transfer any rights in any Justin Choquette Studio IP Assets or in any other Justin Choquette Studio intellectual property rights from Justin Choquette Studio to any users. 3.4 Justin Choquette Studio IP Assets may not be used by user without the prior written permission from Justin Choquette Studio. Any rights not expressly granted herein to User are reserved to Justin Choquette Studio. In addition to any other conditions on the user’s Access Right as set forth in this Agreement, the user’s Access Right is subject to the following additional conditions: (i) user shall not modify, disassemble, decompile or reverse translate or create derivative works from any of the Justin Choquette Studio IP Assets or otherwise attempt to derive any source code of the same or let any third party do the same; (ii) no copyrighted material, content, or any other Justin Choquette Studio IP Assets may be downloaded, modified, copied, displayed, transferred, distributed, sold, published, broadcast or otherwise used except as expressly stated either in such materials or in this notice without the express prior written permission of Justin Choquette Studio (which Justin Choquette Studio may or may not grant in its sole discretion); (iii) user shall not remove, alter, cover or obscure any copyright notices or other proprietary rights notices of JUSTIN CHOQUETTE STUDIO or any other party placed on or embedded in the Justin Choquette Studio IP Assets and shall otherwise retain all such notices on all copies of the same; and (iv) use of any of the Justin Choquette Studio IP Assets is prohibited unless user is an authorized User in good standing. Unauthorized use is a violation of copyright and other intellectual property rights and is actionable under law. 3.5 User agrees to keep strictly confidential all Justin Choquette Studio IP Assets that have not been made publicly available by Justin Choquette Studio. User also acknowledges and agrees that the terms and conditions of this provision shall survive the cancellation, expiration, or termination of this Agreement for any reason. 4. PRIVACY. 4.1 User agrees that: (i) if the user has any User Content or any User login or password that it uses in association with the Justin Choquette Studio Website or Justin Choquette Studio Program or is otherwise used in association with any Trip Service, then User is solely responsible for maintaining the confidentiality of the same; and (ii) if the user has any login or password associated with the Justin Choquette Studio Website or Justin Choquette Studio Program or that is otherwise used in association with any Trip Service, then the user: (a) is solely responsible for all uses of its login and password regardless of whether these uses are authorized by the user, and (b) the user will immediately notify Justin Choquette Studio of any unauthorized use of the User’s login and password. 4.2 Each user’s access to and use of the Justin Choquette Studio Website or any other Justin Choquette Studio Programs, including without limitation using any of the Trip Services, is subject to the Justin Choquette Studio’s Privacy Notice, a copy of which is available here https://justinchoquettestudio.com/terms#privacy, and which is hereby incorporated by reference into this Agreement (“Justin Choquette Studio Privacy Policy”). IN ADDITION TO ANY OTHER APPLICATIONS OR USES OF PERSONAL INFORMATION AS SET FORTH IN THE JUSTIN CHOQUETTE STUDIO PRIVACY POLICY, THE COLLECTION, USE, DISCLOSURE AND OTHER PROCESSING OF A USER’S PERSONAL INFORMATION IS GOVERNED BY THE JUSTIN CHOQUETTE STUDIO PRIVACY POLICY. As a result of such incorporation, each User hereby agrees to comply with the Justin Choquette Studio Privacy Policy, as it may be amended from time to time by Justin Choquette Studio. 5. TRAVELER’S BOOKING TERMS AND CONDITIONS; SCOPE OF JUSTIN CHOQUETTE STUDIO’S TRIP SERVICES. 5.1 Booking; Justin Choquette Studio’s Trip Services for Travelers. 5.1.1 All bookings of a Trip by a Traveler must be made with Justin Choquette Studio by using the Website or another authorized Justin Choquette Studio Program that has been made available to the Traveler by Justin Choquette Studio. By booking a Trip (“Booking(s)” or “Book a Trip”) with Justin Choquette Studio you hereby are deemed to have agreed to this Agreement, including without limitation all of the provisions of this Section 5 governing the Booking, and your Booking will only be accepted by Justin Choquette Studio on this basis. Unless otherwise stated on your Trip Page cancellation policy, your payment terms are specifically defined below. 5.1.2 The Trip services to be provided by Justin Choquette Studio when a Traveler Books a Trip when using the Justin Choquette Studio Website or any other Justin Choquette Studio Program will be limited to acceptance of the Booking and Justin Choquette Studio’s processing of Trip Payments (as defined above) as described in that Booking (the “Trip Services”). FOR CLARITY, AND WITHOUT LIMITING THE FOREGOING IN ANY WAY, THE TRAVELER HEREBY ACKNOWLEDGES AND AGREES THAT THE SOLE AND EXCLUSIVE RESPONSIBILITY AND LIABILITY OF JUSTIN CHOQUETTE STUDIO RELATED TO OR ARISING OUT OF THE BOOKING AND THE TRIP SERVICES SHALL BE LIMITED TO JUSTIN CHOQUETTE STUDIO’S PROCESSING OF THE TRIP PAYMENTS TO THE APPROPRIATE THIRD PARTY PURSUANT TO THE TERMS AND CONDITIONS OF THE PARTICULAR BOOKING 5.1.3. All other services related to the Booking are the sole and exclusive responsibility of the Operator of the Trip (the “Operator”) identified in the Booking (or the Host, as applicable), and are subject to the terms and conditions of any agreements between you and the Operator (or any Host, as applicable). The Operator is solely responsible for honoring any confirmed Bookings and making available any Trips reserved through the Services. The Operator is also solely and exclusively responsible for providing all legally required information to you. If you choose to enter into a transaction with an Operator for the Booking of a Trip, you hereby agree to accept any terms, conditions, rules, and restrictions associated with such Booking imposed by the Operator and will receive necessary information from the Operator only. You further acknowledge and agree as follows with regard to all Bookings involving all such Operators: (a) We are not a party to your agreement with any Operator but only act as a neutral third party that facilitates your introduction to that Operator; (b) Our sole responsibility under this Agreement, including without limitation with regard to all Bookings and Trip Services, is to transmit the Trip Payments to that Operator; and (c) We do not have, and do not accept, any responsibility arising from or related to any of your agreements with the Operator or any other third party unless explicitly required by applicable law. 5.2 Down Payment Requirement. To reserve your spot, we require a $3990 deposit per person per Booking. This deposit is refundable for 48 hours after booking. Your deposit becomes non-refundable after this 48-hour period. Your remaining payment is subject to the following refund policy: - More than 90 days before the trip = 70% refund on the remaining payment. - Between 90 and 60 days before the trip = 30% refund on the remaining payment. - Less than 40 days before trip departure = 0% refund on the remaining payment. We highly recommend purchasing trip insurance. 5.3 Trip Cancellation by Us: We may cancel a trip prior to the start date for reasons including (but not limited to) insufficient participation, weather conditions, pandemics, or other instances that may impede trip operations. In this case, you will receive a refund for funds paid towards the trip cost. However, you will not receive any payment for any hotels, flights, or transportation booked before or after the trip. A legal language version of our trip cancellation is this... We reserve the right to cancel any trip, at any time, prior to the scheduled departure date for any reason whatsoever, including without limitation, insufficient participation, local weather conditions, or logistical problems that, in our sole judgment, may impede trip operations. In the event we cancel your trip for any reason whatsoever other than a force majeure event, your sole and exclusive remedy shall be the refund of all payments we received from you as of the date of cancellation. Our payment of the refund shall release us from any and all other or further liability in any way related to such cancellation. We may make payments to our suppliers (permits, transportation companies, etc.) far in advance of the scheduled trip departure date. Accordingly, if a trip is canceled due to a force majeure event (e.g. acts of God, war, labor strikes, earthquake, flooding, pandemics, or any other cause beyond our control), we will undertake commercially reasonable efforts to promptly refund the portion of any amounts paid by you that have, in turn, not already been advanced to suppliers. In addition, we will use commercially reasonable efforts to recover and refund to you the balance of your payment amounts that were advanced to suppliers, less our expenses, if any, of such recovery, as promptly as possible. However, we do not guarantee your recovery of any portion of advance payments made to our suppliers. We are not responsible for, and you hereby release and forever discharge us from, any expense or cost incurred by you in preparing for or arising or resulting from a canceled trip. If you cancel your trip, we will refund your payment as follows: (a) cancellation 90 days or more prior to trip departure – 70% of your payment will be refunded, with the exception of the deposit amount; (b) cancellation between 90 - 60 days prior to trip departure - 30% of your payment will be refunded, with the exception of the deposit amount; or (c) cancellation less than 40 days prior to departure, or during the trip – no refund will be made. 5.6 Your Details. In order for us, Justin Choquette Studio, to confirm your travel arrangements for the Booking of your Trip, you must provide all requested details 45 days prior to Departure Date. Necessary details vary by Booking and may include, without limitation, full name as per passport, date of birth, nationality, passport number, passport issue and expiry date, and any pre-existing medical conditions you have which may affect your ability to complete your travel arrangements. Failure to provide requested details 45 days prior to Departure Date may result in additional charges or non-refundable cancellation of your Booking. 5.7 Cancellation by the Traveler. If you cancel some or all portions of your Booking, cancellation fees will apply. A cancellation will only be effective when we, Justin Choquette Studio, receive written confirmation of the cancellation. Payments shall be refundable pursuant to the following: 5.7.1 If you cancel any Booking that is confirmed, on or after the date that is 90 days prior to the Departure Date, the Down Payment and Additional Payments will be retained by Justin Choquette Studio and are non-refundable to you. 5.7.2 For Departure Dates more than 90 days in advance, if your Booking has not yet been confirmed, and you cancel the Booking, you shall either be granted a full refund of your Down Payment or be granted a credit for the amount of the Down Payment. 5.7.3 For Departure Dates more than 90 days in advance, if your Booking has been confirmed, and you cancel the Booking outside of 72 hours from notification being sent, you shall be granted a trip credit in the amount of the Down Payment, less a $100 cancellation fee for each spot canceled. Note that different cancellation conditions, including higher charges, apply to some styles of booking and additional services, as provided in your confirmation email. If you leave a trip for any reason after it has commenced, we, Justin Choquette Studio, are not obliged to make any refunds for unused Services. If you fail to join a Trip, join it after departure, or leave it prior to its completion, no refund will be made. The above cancellation fees are in addition to fees which may be levied by accommodation providers, travel agents, or third-party tour and transport operator fees. We, Justin Choquette Studio, are not responsible for any unfavorable exchange rate fluctuations that may lead to a smaller refund in your local currency. 5.8 Cancellation by Justin Choquette Studio. 5.8.1 For Any Reason. We, Justin Choquette Studio, may cancel a Booking for any reason up to 45 days before the Departure Date. Except as provided below, if we cancel your Booking, you can transfer the Down Payment and Additional Payments to an alternate Departure Date or receive a full refund. In case of any cancellation for any reason, we are not responsible for any incidental expenses that you may have incurred as a result of your Booking, including but not limited to, visas, vaccinations, unfavorable exchange rate fluctuations, travel insurance excess, or non-refundable flights. 5.8.2 Force Majeure Event. Notwithstanding the above, Justin Choquette Studio shall not be liable or responsible to you, nor be deemed to have defaulted under or breached this Agreement, for any failure or delay in fulfilling or performing any term of this Agreement (including without limitation any terms of a Booking), when and to the extent such failure or delay is caused by or results from acts beyond Justin Choquette Studio’s reasonable control, including, without limitation, the following force majeure events (“Force Majeure Event(s)”): (a) acts of God; (b) flood, fire, earthquake, pandemics, epidemics, drought, bushfire, storm, or other natural disaster, explosion, or public health and safety emergency characterized by an applicable government authority; (c) war, invasion, hostilities (whether war is declared or not), terrorist threats or acts, riot, or other civil unrest; (d) government order, law, or actions; (e) embargoes or blockades in effect on or after the date of this Agreement; (f) national or regional emergency; (g) strikes, labor stoppages, or slowdowns, or other industrial disturbances; (h) shortage of adequate power or transportation facilities; (i) other events beyond the reasonable control of Justin Choquette Studio. In case of a Force Majeure Event, Justin Choquette Studio shall reschedule your Booking for a future date and provide you written notice of the same. Within 30 days of notice of the Force Majeure Event, you may cancel the rescheduled Booking, and will be granted (j) a credit in the amount of the Down Payment; and (k) either a credit or a refund of the Additional Payments. 5.8.3 Violation of Community Guidelines We, Justin Choquette Studio, may cancel a Booking and remove you from a Trip and the platform for any violation of the Community Guidelines as outlined here. If we cancel your Booking, the Down Payment and Additional Payments made will be fully refunded. 5.9 Cancellation by Operator. 5.9.1 If an Operator cancels the Trip with more than 30 days’ notice prior to the Departure Date, and does not reschedule the Trip, you may elect to obtain a full refund of the Down Payment and Additional Payments, or a credit in the amount of the Down Payment and Additional Payments. 5.9.2 If an Operator reschedules the Trip and your Booking with more than 30 days’ notice prior to the departure date, you shall be granted a credit in the amount of the Down Payment, and at your election, a credit or full refund of the Additional Payments. 5.9.3 If an Operator cancels the Trip with 30 days or less notice prior to the Departure Date, a. If the cancellation was caused due to Operator error or negligence, Justin Choquette Studio may, but is not obligated, to recover funds from the Operator and issue a refund to you accordingly; b. If the operator cancels a Trip due to a Force Majeure Event, any recovered funds will be refunded to the Traveler. 5.10 Cancellation by or Removal of Host. 5.10.1 Except in the event of Force Majeure, if the Host cancels your Trip and/or Booking prior to 45 days of the Departure Date, you can transfer the Down Payment and Additional Payments to an alternate Departure Date or receive a full refund. 5.10.2 Except in the event of Force Majeure, if the Host cancels their participation in your Trip within 45 days of the Departure Date, the Trip will continue as planned and the Booking shall remain subject to these terms including, without limitation, the Traveler cancellation restrictions in Section 5.7 above. 5.10.3 In case of any cancellation for any reason, we, Justin Choquette Studio, are not responsible for any incidental expenses that you may have incurred as a result of your Booking, including but not limited to, visas, vaccinations, unfavorable exchange rate fluctuations, travel insurance excess, or non-refundable flight. 5.11 Inclusions & Exclusions. Unless specified in your contract with the Operator, or as part of a Designer Trip, the price of your Booking through Justin Choquette Studio includes: All accommodation as listed All transportation as listed Activities listed Meals as listed Trip leader as listed Otherwise, the price of your booking does not include any other services or products, and excludes without limitation, the following: International or internal flights unless specified Taxes and excess baggage charges unless specified Meals and Beverages other than those specified Visa and passport fees Travel insurance Optional activities and all personal expenses Tour guide tips 5.12 Age & Health Requirements. You must be at least 18 years of age to use the Trip Services, including, without limitation, booking any Trip. If you are Booking for an additional Traveler who is a minor or if you bring a minor to a trip, you must be at least 25 years of age, be legally authorized to act on behalf of the minor, and provide an executed guardian waiver in a form acceptable to Justin Choquette Studio, in its sole discretion. You are solely responsible for the supervision of that minor. By Booking a trip using the Trip Services, you confirm you are at least 18 years of age. It is your sole responsibility to ensure that you are suitably fit to allow full participation in the trip and to obtain proper and detailed medical advice for the latest health requirements and recommendations for your destination. Justin Choquette Studio and our local Operators reserve the right to remove any Traveler, or deny any paid service to a Traveler, due to concerns over the health and safety of the individual or the group as a whole. Any health or safety-related removal or denial is at the discretion of Justin Choquette Studio and/or the authority on Trip. 5.13 Passport and Visas. You must carry a valid passport and obtain all of the appropriate visas, permits and certificates for the countries which you will visit during your Trip with Justin Choquette Studio. Your passport must be valid for 6 months beyond the duration of the booking. It is your sole responsibility to ensure that you are in possession of the correct visas, permits and certificates for your Trip. Justin Choquette Studio is not responsible if you are refused entry to a country because you lack the correct passport, visa or other travel documentation. 5.14 Travel Insurance. Travel insurance is recommended for all our travelers booking with Justin Choquette Studio and should be taken out at the time of Booking. Your travel insurance should provide cover against personal accident, death, medical expenses and emergency repatriation with a recommended minimum coverage of $200,000 USD for each of the categories of cover. We also strongly recommend the travel insurance policy include coverage for cancellation, curtailment, personal liability and loss of luggage and personal effects. If an Operator requires travel insurance, you will be advised a minimum of 90 days prior to departure. A policy holder and policy number in the Traveler’s name must be provided to Justin Choquette Studio at a minimum of 72 hours prior to departure. 5.15 . You agree and acknowledge that the nature of this type of travel with Justin Choquette Studio requires considerable flexibility and you should allow for alternatives. The itinerary provided for each Booking is representative of the types of activities contemplated, but it is understood that the route, schedules, itineraries, amenities and mode of transport are subject to alteration without prior notice, and Justin Choquette Studio is not liable for any such changes. 5.16 Change of Itinerary. The Operators of Justin Choquette Studio reserve the right to change the Trip itinerary. Please refer to our Website or other Company Programs before departure for the Operator’s most recent updates to the trip itinerary. It Is the Operator’s, and not Justin Choquette Studio's, sole responsibility to update the Booking itinerary. 5.16.1 Before Departure. If the Operator makes a major change, we will inform you as soon as reasonably possible if there is time before the Departure Date. The definition of a major change is defined as a substantial alteration to an itinerary which can include but is not limited to; length of stay, departure date, overnight location outside of 100-mile radius of advertised location. 5.16.2 When a major change is made, you may choose between accepting the new itinerary or canceling your Booking and obtaining a Trip Credit, without penalty, to be used on an alternative departure. 5.16.3 After Departure. The Operators of Justin Choquette Studio reserve the right to change an itinerary after Departure Due to local circumstances or events outside of their control. The additional cost of any necessary itinerary alterations will be your sole responsibility. Please note we are not responsible for any incidental expenses that may be incurred, including without limitation, expenses incurred as a result of the change of itinerary such as visas, vaccinations, or non-refundable flights. 5.17 Authority on Trip. If you fail to comply with a decision made by an Operator or any Trip Leader identified by Operator, or interfere with the well-being or mobility of the group, the Operator or trip manager, if identified in the Booking, may direct you to leave the trip immediately, with no right of refund. Justin Choquette Studio may also elect not to provide you Services in the future. You must at all times comply with the laws, customs, foreign exchange, and drug regulations of all countries visited, and you also agree to travel in accordance with Justin Choquette Studio’s responsible travel guidelines. 5.18 Acceptance of Risk. You acknowledge that the nature of the Trip with Justin Choquette Studio is adventurous and participation involves a degree of personal risk. You will be visiting places where the political, cultural, and geographical attributes present dangers and physical challenges greater than those present in our daily lives. It is your sole responsibility to acquaint yourself with all relevant travel information and the nature of your itinerary. You acknowledge that your decision to travel is made in light of consideration of this information, and you accept that you are aware of the personal risks attendant upon such travel. 5.19 Optional Activities. Optional activities not included in the Booking price do not form part of the Booking or this Agreement. You accept that any assistance given by your group leader or local representative in arranging optional activities does not render us liable for them in any way. The contract for the provision of that activity will be between you and the activity provider or Operator. 5.20 Claims & Complaints. If you have a complaint about your Trip with Justin Choquette Studio, please inform your Trip Leader identified by the Operator at the time in order that they can attempt to rectify the matter. If satisfaction is not reached through these means, then any further complaint should be put in writing to Justin Choquette Studio within 30 days of the end of the trip. 5.21 Severability. In the event that any terms or conditions related to the Booking or the Trip Services, or any other terms and conditions contained in this Agreement, are unenforceable or void by operation of law or as being against public policy or for any other reason, then such term or condition shall be deemed to be severed from this Agreement or amended accordingly only to such extent necessary to allow all remaining terms and conditions to survive and continue as binding. 5.22 Photos and Marketing. You consent to Justin Choquette Studio using images of you taken during the trip for advertising and promotional purposes in any medium Justin Choquette Studio chooses. You grant Justin Choquette Studio a perpetual, royalty-free, worldwide, irrevocable license to use such images for publicity and promotional purposes. 5.23 Company Privacy Policy Governs Bookings. Any personal information that we collect about you may be used for any purpose associated with the operation of a Booking or otherwise associated with the Trip Services, or to send you marketing material in relation to our events and special offers. The information may be disclosed to our agents, service providers, or other suppliers to enable us to provide the Trip Services. We will otherwise treat your details in accordance with our Company Privacy Policy (as defined in Section 4 of this Agreement). 5.24 Pre-Trip Behavior. Justin Choquette Studio may cancel a Booking at any time prior to the Departure date due to any Traveler actions, inactions, communications, or any other behavior that Justin Choquette Studio deems to be a security concern or that may impact the dynamic and safety of the Trip, as determined by Justin Choquette Studio in its sole discretion. In the event of such cancellation, you may not be entitled to any refund or compensation. Justin Choquette Studio may also elect not to provide you Services in the future. 5.25 COVID-19 Vaccination Requirements. Some Hosts may require that all Travelers on the Trip are fully vaccinated against COVID-19. This requirement will be displayed via website copy at the time of Booking. If required, on the Departure Date, all Travelers must certify that they have been fully vaccinated as defined by the relevant national authority by Departure Date. The Host vaccination requirement is in addition to the vaccination and/or testing requirements enforced by the local authorities within the destination of travel. Justin Choquette Studio will not facilitate the collection of proof in regards to vaccination status and is not responsible for providing or verifying this information. Host is solely responsible to implement, administer, and enforce such vaccination requirement. Traveler agrees and acknowledges that Justin Choquette Studio disclaims all liability related to such vaccine requirements and the implementation and enforcement of such requirements. 5.26 Luggage Restrictions. All travelers are allowed to bring one large piece of luggage (not exceeding 23kg (50lbs) in weight, with the dimensions (30” x 18” x 10”), one small carry-on (12”x11”x6”), and a personal item). Any additional luggage brought on a trip without Company’s pre-approval may result in additional storage fees to be paid by the Traveler. 5.27 On-Trip Behavior: The Company and or authority on Trip reserves the right to remove a Traveler at any time while on trip due to any Traveler actions, inactions, communications, or any other behavior that Justin Choquette Studio deems to be a security concern or that may impact the dynamic and safety of the Trip, as determined by Justin Choquette Studio in its sole discretion. In the event of such removal, the Traveler may not be entitled to any refund or compensation. Justin Choquette Studio may also elect not to provide the Traveler Services in the future. 5.28 Early Departure from a Trip: Any additional fees or costs incurred due to an early departure from the Trip, whether voluntary or at the request of Justin Choquette Studio and/or the authority on trip, are the sole responsibility of the Traveler. This includes official removal from the Trip due to behavior, violation of community guidelines and/or health and safety concerns. 6. DISCLAIMERS; LIMITATION OF LIABILITY. EXCEPT FOR JUSTIN CHOQUETTE STUDIO’S LIMITED AND EXPLICIT PROMISE UNDER SECTION 5.1.2 TO PROCESS THE TRIP PAYMENTS OF A TRAVELER PURSUANT TO THE TERMS AND CONDITIONS OF THAT TRAVELER’S BOOKING: (A) JUSTIN CHOQUETTE STUDIO MAKES NO REPRESENTATIONS, WARRANTIES, OR OTHER COVENANTS TO THE TRAVELER OR ANY OTHER USER REGARDING THE COMPANY WEBSITE, ANY OTHER COMPANY PROGRAMS, ANY TRIP, ANY TRIP SERVICES, ANY OTHER COMPANY IP ASSETS, AND ANY OTHER CONTENT PROVIDED THEREIN; AND (B) THE COMPANY WEBSITE, ANY OTHER COMPANY PROGRAMS, ANY BOOKINGS, TRIP SERVICES, ANY COMPANY IP ASSETS AND ANY OTHER CONTENT PROVIDED THEREIN ARE ALL PROVIDED TO A TRAVELER AND ALL OTHER USERS ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND. JUSTIN CHOQUETTE STUDIO HEREBY EXPLICITLY DISCLAIMS ANY AND ALL REPRESENTATIONS OR WARRANTIES, EITHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY: (A) WARRANTY OF MERCHANTABILITY; (B) WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE; OR (C) WARRANTY AGAINST INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS OF A THIRD PARTY; WHETHER EXPRESS OR IMPLIED BY LAW, COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE OF TRADE, OR OTHERWISE. JUSTIN CHOQUETTE STUDIO MAKES NO REPRESENTATIONS OR WARRANTIES WITH RESPECT TO ANY PRODUCTS OR SERVICES OF ANY HOST, OPERATORS OR ANY OTHER THIRD PARTY, INCLUDING WITHOUT LIMITATION ANY OF THE FOLLOWING WITH REGARD TO THE FOREGOING: (A) WARRANTY OF MERCHANTABILITY; (B) WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE; (C) WARRANTY OF TITLE; OR (D) WARRANTY AGAINST INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS OF A THIRD PARTY; WHETHER EXPRESS OR IMPLIED BY LAW, COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE OF TRADE, OR OTHERWISE. FOR PURPOSES OF THIS SECTION 6, THESE THIRD PARTY PRODUCTS AND SERVICES INCLUDE PRODUCTS OR SERVICES OF HOSTS OR OPERATORS. WITHOUT LIMITATION TO THE GENERALITY OF ANY OTHER PROVISION IN THIS SECTION 6, AND FOR THE AVOIDANCE OF DOUBT, EACH TRAVELER HEREBY ACKNOWLEDGES AND AGREES THAT: (A) THE SOLE AND EXCLUSIVE RESPONSIBILITY AND LIABILITY OF JUSTIN CHOQUETTE STUDIO RELATED TO OR ARISING OUT OF THE TRAVELER’S BOOKING AND THE TRIP SERVICES SHALL BE LIMITED TO JUSTIN CHOQUETTE STUDIO’S PROCESSING OF THE TRIP PAYMENTS TO THE APPROPRIATE THIRD PARTY PURSUANT TO THE TERMS AND CONDITIONS OF THE PARTICULAR BOOKING; AND (B) ALL OTHER SERVICES RELATED TO OR ARISING OUT OF THE TRAVELER’S BOOKING OR TRIP, AND ALL OBLIGATIONS RELATED THERETO, ARE SOLELY AND EXCLUSIVELY THE RESPONSIBILITY AND LIABILITY OF THE OPERATOR, HOST OR OTHER THIRD PARTIES PROVIDING SUCH SERVICE AND ARE NOT THE RESPONSIBILITY OR LIABILITY OF JUSTIN CHOQUETTE STUDIO. IN NO EVENT SHALL JUSTIN CHOQUETTE ST UDIO BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INJURY, PERSONAL INJURY, DEATH, PROPERTY DAMAGE, OR OTHER CONSEQUENTIAL, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES WHETHER ARISING OUT OF BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE AND WHETHER OR NOT JUSTIN CHOQUETTE STUDIO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND NOTWITHSTANDING THE FAILURE OF ANY AGREED OR OTHER REMEDY OF ITS ESSENTIAL PURPOSE. IN NO EVENT SHALL JUSTIN CHOQUETTE STUDIO’S AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THIS AGREEMENT (INCLUDING WITHOUT LIMITATION ARISING OR RELATED TO A TRAVELER’S BOOKING OR TRIP), WHETHER ARISING OUT OF OR RELATED TO BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, EXCEED THE TOTAL OF THE AMOUNTS PAID TO JUSTIN CHOQUETTE STUDIO FOR THE TRIP SERVICES SOLD HEREUNDER. 7. INDEMNIFICATION. You hereby agree to defend, indemnify and hold harmless Justin Choquette Studio, its affiliates, and their officers, directors, employees, agents, licensors, content providers, successors and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees (including reasonable attorneys’ fees) resulting from your violation of this Agreement, including without limitation: (a) any unauthorized use of the Company Website, any Company Programs, any Company IP Assets, or any content thereof; or (b) any actions of a Traveler during a Trip. 8. LINKS TO THIRD-PARTY WEBSITES. The Company Website, other Company Programs, or our Trip Services may contain links to third-party websites. These links are provided for your convenience only. Justin Choquette Studio has no control over third-party websites and we are not responsible for the content of such websites or the privacy practices of those third-party websites. If you decide to access a third-party website linked from the Company Website, other Company Programs, or our Trip Services, you do so entirely at your own risk, and your use of those sites is subject to those websites’ terms and conditions and privacy policies. 9. GOVERNING LAW; JURISDICTION, DISPUTES. READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS AND IMPACTS HOW CLAIMS YOU AND JUSTIN CHOQUETTE STUDIO MAY HAVE AGAINST EACH OTHER ARE DETERMINED. 9.1 Governing Law. We control and operate the Company Website, our Company Programs, and our Trip Services from the Province of British Columbia, Canada. While we invite users from all parts of the world to visit the Company Website and other Company Programs and to use our Trip Services, each user hereby acknowledges and agrees that the Company Website, other Company Programs, and our Trip Services, and all activities available on and through the foregoing, are governed by the laws of the Province of British Columbia, Canada. Accordingly, You hereby expressly agree that the laws of the Province of British Columbia, Canada, excluding its conflict of laws rules shall govern this Agreement, including without limitation our Company Privacy Policy and your use of the Company Website, any other Company Programs, and our Trip Services. 9.2 Jurisdiction. You hereby expressly agree that exclusive jurisdiction for any claim or dispute with us (or any of our affiliates) related to or arising out of this Agreement shall be the federal and/or provincial courts in the Province of British Columbia, Canada, and you further agree and expressly consent to the exercise of personal jurisdiction the federal and provincial courts in the Province of British Columbia, Canada, in connection with any such dispute and including any claim involving us or our affiliates, subsidiaries, employees, contractors, officers, directors, or agents. 9.3 Prohibition of Class or Representative Actions. You and the Company agree that each of us may bring claims against the other only on an individual basis and not as a plaintiff or class member in any purported class or representative action. 10. CHANGES TO THIS AGREEMENT. BY USING THE COMPANY WEBSITE, ANY COMPANY PROGRAM OR ANY TRIP SERVICES (INCLUDING WITHOUT LIMITATION BOOKING ANY TRIP THEREIN), YOU HEREBY AGREE AS FOLLOWS: 10.1 The company reserves the right, at our discretion and at any time, to make changes to any of the provisions of this agreement, including without limitation changes to any of the terms and conditions governing a booking of a trip or to the company privacy policy (hereinafter “Updates to this Agreement”). 10.2 The Company may take any reasonable efforts to post any such Updates to this Agreement, including without limitation posting such Updates to this Agreement on the Company’s main Website. 10.3 Continued use of any Company Website, any other Company Program, or any of the Company’s Trip Services by any user (including but not limited to any traveler) shall automatically constitute such user’s (including without limitation such Traveler’s) immediate acceptance of and consent to all of the updates to this agreement and you will thereafter be bound by such Updates to this Agreement. 10.4 If you do not agree to such Updates to this Agreement, then you should immediately discontinue using the Company Website, all other Company Programs, and all of the Company’s Trip Services. 11. MISCELLANEOUS PROVISIONS. 11.1 Entire Agreement; Waiver; Severability. This Agreement constitutes the entire agreement between the Company and each user (including without limitation each Traveler) with respect to the subject matter hereof, and supersedes and replaces any prior agreements we might have had between us regarding such subject matter. The Company’s failure to enforce any right or provision of this Agreement will not be considered a waiver of those rights. If any provision of this Agreement is held to be invalid or unenforceable by a court, the remaining provisions of this Agreement will remain in effect. 11.2 Remedies. User acknowledges that monetary damages may not be a sufficient remedy for unauthorized use of the Company Website, any other Company Program, any Trip Services, or any other Company IP Assets and therefore each user hereby agrees that the Company shall be entitled, without waiving any other rights or remedies, to such injunctive or equitable relief as may be deemed proper by a court or arbitration panel of competent jurisdiction without necessity of posting a bond and without having to plead and prove a lack of an adequate remedy at law. 11.3 Attorney Fees. If any suit or action is filed by any party to enforce this Agreement or otherwise with respect to the subject matter of this Agreement, the prevailing party shall be entitled to recover reasonable attorney fees incurred in preparation or in prosecution or defense of such suit or action as fixed by the trial court and, if any appeal is taken from the decision of the trial court, reasonable attorney fees as fixed by the appellate court. 11.4 Binding Effect; No Assignment by Client; Permissible Assignment by Company. This Agreement shall be binding upon and inure to the benefit of each party’s respective successors and lawful assigns; provided, however, that user (including without limitation the Traveler) may not assign this Agreement, in whole or in part, without the prior written consent of the Company (which it may or may not grant in its discretion). Any purported assignment in violation of this Section 11.4 shall be void. The Company shall have the right to assign this Agreement, or any part of it, in its sole discretion to any party, and all covenants and agreements hereunder shall inure to the benefit of and be enforceable by such successors and assigns. 12. Participants are responsible for their own safety and well-being during the workshop and should ensure they have adequate insurance coverage for their equipment and personal health. Justin Choquette / Justin Choquette Studio are not responsible for any loss or damage to personal property, injuries, or accidents that may occur during the workshop. Participants agree to comply with all safety instructions and guidelines provided by Justin Choquette / Justin Choquette Studio during the trip.
